ORDER

SH. RAKESH KAPOOR, PRESIDENT

Both the complaints arise out of identical facts and
are being disposed of by this common order. In complaint no. 126/10,
the complainant has alleged that   he had applied to the OP under the
scheme of slum housing yojana (handicapped category) and had made a
payment of Rs. 3,000/- towards the registration.   It is alleged by
him that he had lost the registration certificate and other papers but
had then found out from the record that his registration no. was GH
8501 /2112 / DD / H 09 B.   The complainant had requested the slum
department for the status of his application and was informed since
his name occurred in the general category, he is not entitled to a
house as per Slum House Yojana 1985.  The complainant has alleged that
this act of the OP was unwarranted as he was registered under a
physically handicapped category. He has , therefore, approached this
forum for a direction to the OP to provide him with a shelter/ house
as per the scheme of the OP .
In case 292/2014, the complainant has alleged that he had applied for
allotment of a flat under the residential flat registration scheme
1985 and had made a deposit of Rs 3000/- as registration money.   This
was done in the year 1985 and despite the fact that many years have
passed , he has not been handed over the promised flat/ plot   .
Hence, the complaint.
Earlier this matter was being dealt with by the MCD but later on a
board with the name of Delhi Urban Shelter Improvement board was
created by the Govt. of NCT of Delhi.  The Delhi Urban Shelter
Improvement board has filed a reply in both the cases . In case of
Shravan Kumar( complaint no. 126/2010 ), it has been stated that he is
registered against no. 21112 and his priority number is 9334 / PH .
It is further stated that till date allotment has been made upto 2331/
PH.  In the case of Premchand Mittal (complaint no 294/2013), it has
been stated that his registration number is 3818 with priority number
18099/G.   It is further stated that till date allotment has been made
upto 2650/G on Hire Purchase basis and 6205/G on cashdown basis. It is
, therefore, clear that both the complaints have not reached their
priority numbers and as such no allotment has been made in their
favour.   It has also been stated on behalf of the OP that the
Department is considering formulation of another scheme for allotment
of flats to these registrants, a draw of lot for which may be held in
the year 2016.  In view of the situation which has been explained we
see no deficiency in service on the part of the OP .  The complaints
are without merits and are accordingly dismissed.
The original order shall be kept in complaint no 126/2010 and a copy
shall be kept in complaint no. 294/2014/.
Copy of the order be made available to the parties as per rule.
File be consigned to record room.
Announced in open sitting of the Forum on.....................
