The gist of the complaint is that the complainant was using Metro Travel Service and had a valid card. It is alleged that he faced physical and mental harassment on 19/04/2017 and 22/04/2017 as the machine installed at exit of Vishwavidhyalaya Metro station, GTB Nagar and Welcome Metro Station failed to read the complainants Metro card at the time of exit and therefore, he had to remain stuck inside the metro station for a long time. It is alleged that the Metro card issued by the OP against a security amount of Rs. 50 developed some technical problems causing such difficulties to the complainant. The matter was reported to the employees but with no outcome.
The OP was noticed and filed written statement. Both the parties filed their evidence.
During the course of arguments the Authorized Representative of the OP informed that she had brought a new Metro card with the balance deposited by the complainant to hand over to complainant against the old one. The complainant accepted the said card and restricted his prayer for orders on the point of physical, mental harassment and the litigation cost.
We have considered the rival submissions. The metro card has already been accepted by the complainant. The incidents mentioned in the complaint relate to two days which caused inconvenience and harassment to the complainant.
The employees of the OP also did not resolve the issue despite complaint and so he was forced to file the present complaint. In these facts, we are of the considered view that there is deficiency in service on the part of OP and accordingly direct as under:-
The Orders shall be complied within 30 days from the date of receipt of this order.
Copy of the order may be forwarded to the parties to the case free of cost as statutorily required.
