Present : None
Complainant has filed the present case inter alia stating that complainant has purchased a Flat i.e. U-120 Ground Floor, Shakarpur, Delhi in which water motor and water meter were installed but unfortunately the same was stolen in the year 2003. The complainant has not received any water bill from the year 2000 upto 09.03.2024 and now he has received a bill of huge amount which is a deficiency in service on the part of OP as the water was never used from the year 2000 upto 09.03.2024 and the bill of the OP dated 09.03.2024 is illegal and without any basis. Therefore, it is inter alia prayed that the bill dated 09.03.2024 be waived off or Commission may pass any other order.
The Complainant appeared in person and argued that he had already sold the property in May 2024 and is not residing at this address at present. The Commission has informed from the complainant that once he has already sold the property, as admittedly he has sold the Flat on 30.05.2024 vide registered sale deed 2024/5/4356 and registration No.2024/5/4409 in Book No.1, volume No.2415, Page No.165-184 dated 03.06.2024, then how he is a consumer of OP to which complainant in person submits that Commission may pass any order. Law is well settled.
Hon’ble NCDRC in Revision Petition No.2562/2012 titled Tata Motors Ltd. & Anr. Vs. Hazoor Maharaj Baba Des Raj & Anr. (In case vehicle was sold which is in question) is held as follows:
In the light of above observations, we find that as complainant did not remain consumer after sale of vehicle and he has sold the vehicle without permission of the District Forum and has suppressed this fact and has not approached the courts with clean hands, complaint is liable to be dismissed.
Therefore, once the complainant has already sold the premises with all its amenities, he is no more a consumer of the OP and accordingly the present complaint is rejected forthwith.
Copy of the order be supplied / sent to the parties free of cost as per rules.
File be consigned to Record Room.
