1. The present complaint has been filed under Section 12 of the Consumer Protection Act, 1986. The brief details of facts, as alleged by the Complainant in the Complaint in hand, are that the Complainant has two water connections from Delhi Jal Board, out of which one is for domestic usage and another is for commercial usage. It has been alleged that Delhi Jal Board/ OP has discontinued the supply of water for these connections w.e.f. 06.03.2019 and has not restored the water supply inspite of number of requests made . It is further alleged that in the month of November 2013, the Metre Reader of Delhi Jal Board/ OP has removed & taken water meter stating that the new meter duly approved by the Delhi Jal Board would be provided/ installed and the meter costs shall be raised in the next bill but till date, no such meter has been provided/installed and the complainant is paying the water bill charges as per the reading taken at the time of removing the meter. Besides, the bill for commercial meter has not been received since 2013 whereas the bill for the domestic connection has not been received since January 2019 and no reading is being given in the bills. It has, therefore, been prayed that the OP be directed to restore the meter connections which were removed on 06.03.2019 and install the new meter approved by the OP so that bills of water usage charges could be paid as per the meter reading.

Accordingly, notice was issued to the OP and in response, the OP has filed its reply stating that the Complainant has not filed any document to substantiate that any water connection has ever been sanction in his name as the copy of the bills filed with the complaint are not in the name of the Complainant. Besides, reply from the Intervener has also been filed during the proceedings.

We have perused the water connection bill dated 06.03.2019 for Rs.500/- and bill dated 06.03.2013 for Rs.334/- filed by the Complainant alongwith the Complainant and observed that none of the bill is in the name of the Complainant. In the bill dated 06.03.2019, the name of the consumer is mentioned as Shabir Ahmad and Tanzim Ahmad S/o Bashir A whereas in the bill dated 06.03.2013, the name of the consumer is mentioned as Shri Abdul Karim. We have also perused the reply/ documents/ evidences filed by the OP & the Intervener in this case and concluded that the Complainant is not covered in the category of the consumer as per the provisions of Section 2(d) of the Consumer Protection Act, 1986. Therefore, the complaint is not maintainable. Hence dismissed.

During the proceedings, it has also been observed that cost of Rs.500/- and Rs.1000/- was imposed upon complainant vide order date 10.10.2019 and 11.11.2019 respectively but the Complainant has not filed proof of the payment till date. Therefore, in view of the non-payment of the cost by the Complainant, the cost imposed upon the Complainant is hereby increased to Rs.5,000/- which shall be deposited in the “ State Consumer Welfare Fund (L/Aid), SBI Account No.10310544717, IFSC No.SBIN0018175” within 30 days from the receipt of this order. Besides, the Complainant is also directed to pay the cost of Rs.5,000/- to the OP (Delhi Jal Board) also within 30 days from the date of receipt of this order failing which this cost would be paid with interest @ 9% per annum till the date of payment.
5. Order be given dasti to the parties in accordance with rules. Order be also uploaded on the website. Thereafter, file be consigned to the record room.
