This an appeal wherein prayer is made for recalling of the order dated 07.04.2017 passed by the District Consumer Disputes Redressal Forum-II, New Delhi in CC No.270/2016 whereby the complaint filed by the appellant herein i.e. the complainant before the District Forum has been dismissed for non-appearance.
It is stated that counsel for the appellant/complainant had lost his diary due to which the matter could not be attended on the date fixed. It is stated that non-appearance on the date fixed was bonafide and due to reasons stated above. Application is supported with the affidavit of the appellant/complainant.
In view of the reasoning given, we accept this appeal, set aside the order dated 07.04.2017 restore the complaint to its original position. Appellant/complainant is warned to be cautious in future.
Parties are directed to appear before the Ld. District Forum on 19.01.2018. Thereafter, the District Forum shall proceed in the matter in accordance with law.
A copy of this order be sent to the parties and also to the District Forum. Thereafter, the file be consigned to Record Room.
