Brief facts of the present complaint  as stated are that the complainant on 4.3.14 applied for water connection with the Opposite Party-Delhi Jal Board in his premises.  But junior engineer of the Opposite Party inspected the premises of the complainant for water connection after 40 days.  He asked the complainant to deposit Rs 16,590/- as development charges.  After five days one  Pramod  Kumar, meter reader  from office of Opposite Party came at the residence of the complainant and inspected the water pipeline.     He asked the  complainant  to pay Rs.5,000/- as illegal gratification for installation of water connection.  The complainant refused to pay the same.    He threatened the complainant to face dire consequences and be  ready to pay Rs.15,000/- as penalty.

The complainant on 25.4.14 deposited the development charges of Rs.16590/-.  He was asked to  visit the office after one week.    When the complainant  visited the office of Opposite Party , he was handed bill date 2.5.14 amounting to Rs.15,35/-for installation of the water meter.  The complainant on 12.9.14  by post made complaint against Pramod Kumar to the senior officers of the Opposite Party .   But no response is given by the Opposite Party.  Hence the present complaint for directions to the Opposite Party to install water connection meter.  He has also prayed for medical expenses to the tune of Rs.80,000/- incurred on treatment of his family members due to comsumption  of dirty water and to take legal action against Parmod Kumar meter reader of opposite party.

               

Notice of the complaint was  sent to the Opposite Party.  But none appeared on behalf of the  Opposite Party.  Hence the Opposite Party was proceeded exparte vide order dated 1.2.16. 

 

                When the complainant was asked to lead exparte evidence he filed affidavit dated 29.1.16 and relied upon copy of receipt dated 28.4.14 , copy of bill dated  29.5.14 and legal notice dated 12.9.14. 

 

                From perusal of the documents relied upon by the complainant,it reveals that the development charges amounting to Rs.16590/- were paid by the complainant on 28.4.14. He was asked to deposit  Rs.15385/- as opening fee, water advance charges, road restoration charge for water, occupier security and additional charges.  There is nothing on the record to show that he has deposited the said charges.  The Opposite Party cannot be directed to install water meter and connect water supply at the premises of the complainant without payment of requisite legal charges.  

 

                We have heard the complainant in person and have gone through the material on record carefully and thoroughly. 

               

The version of the complainant has remained unrebutted and unchallenged.Therefore, there is no reason to disbelieve the unrebutted version of complainant .    The complainant from the unrebutted version has been able to show that he was  to deposit the development charges amounting to Rs.16590/- on 28.4.14.  But he is unable to show any document that he has deposited Rs.15385/-of development charges  as asked  by the Opposite Party .

In light of above discussion and observation the complaint  partly succeeds and is hereby party  allowed .  With   direction to  the Opposite Party to install  water connection at the premises of the complainant within a week from deposit of the legal charge as  per rules and regulations framed by the Opposite Party.
