Complaint under Sec.12 of the CPA 1986 as amended upto date

Complainant is using the water connection no. M0516640000 which is in the name of Smt. Premlata Sehgal.,
It is alleged by the complainant that the OP is supplying dirty/contaminated water to him It is further alleged by the complainant that he filed a complaint regarding the dirty water on Helping No. 8800220704 of Sh. J S Shunty (The MLA) on 8.5.2014, it was assured that the complaint will be resolved very soon.
The complainant contacted Mr. Suresh Chand (J.E.) with water sample and narrated him complaint, who assured him that they will flush this lines and if there is no impact, then they will replace/rejoin the line but no action was taken till today.
It is alleged by the complainant that OP is supplying dirty/contaminated water. This act of OP amounts to deficiency in service as well as an unfair trade practices. Hence, this complaint.
Complaint has been contested by the OP. Para No. 2 and 4 of the reply on merits of the OP is relevant and is reproduced as under:-
2. That the Opposite Party has no knowledge as to whether any complaint was being recorded by the Opposite Party on 8.5.2014 with MLA Sh. Jitender Singh Shunty. However, it is submitted that the moment the complaint was received by JE Sh. Suresh Chand he immediately took an action on the same. The pipeline was flushed and the water samples were taken, the water was found to be potable.
4. That it is submitted that the water lines are being cleaned regularly by field staff of Delhi Jal Board. It is further submitted that the Delhi Jal Board keeps the water norms and standards as per the required specification and potable water is supplied to the consumers.
That the testing reports dated 12.5.2015 and 18.6.2015 counter signed by the complainant himself and other consumers of the same lane is annexed herewith for the kind perusal of the Hon’ble Court.
Both the parties have filed their evidence by way of affidavits.
We have heard the arguments advanced at bar and have perused the record.
The counsel for the OP has contended that, as soon as Sh. Suresh Chand (JE) received the complaint of contaminated water he immediately took an action on it, the pipeline was flushed and the water sample was taken which was found to be potable.
The counsel for the OP has contended that he has also placed on record the testing report dated 12.5.2015 and 18.6.2015 which was counter signed by the complainant and other consumer of the same line in support of his contention.
From the reports dated 12.5.2015 and 18.6.2015 which are not only signed by the applicant but are also signed by the other residents, we are convinced that there is no deficiency in service on the part of the OP .
However, it appear to us that there is a need to keep a regular check and inspect the flow of water in the water pipeline from time to time.
We therefore, direct the concerned JE of the particular division of OP to inspect and prepare a weekly report about the potability of water particularly to the residence of the complainant and file them in this Forum.
With these observations complaint is disposed off.
