                 By way of this appeal, appellant has challenged order dated 29.11.2019 passed by the Consumer Disputes Redressal, Janakpuri, New Delhi in CC No. 108/2019 by which the complaint filed by the appellant herein i.e. complainant before the District Forum has been dismissed in default.

                 It is stated by the AR appearing on behalf of the respondent that copy of the appeal has already received by the respondent with his consent arguments on the appeal are heard.  

                 I have gone through the reasoning given in the appeal which is supported with the affidavit of the appellant/complainant. I have no reason to disbelieve the contention of the  appellant/complainant. After some arguments AR of the respondent states that he has no objection if the appeal is allowed and appellant be given a chance to contest the complaint on merit.

                 In view of the above, I accept the present appeal and set aside the impugn order dated 29.11.2019 restored complaint to its original position. Appellant is directed to be cautious in future.

                 Parties are directed to appear before the District Forum on 27.03.2020.  Thereafter, District Forum shall proceed in the matter in accordance with law.

                 Copy of the order be sent to the District Forum for information.

                 File be consigned to Record Room.
