The counsel for complainant has stated that the physical possession of the plot no. 105  Block D Keshopur Industrial Area, New Delhi  has since been handed over to the complainant by the OP . DDA  during the pendency  of the complaint on 29/09/2006.

However  his  proper are with regard to award the amount towards interest on the deposited amount compensation for mental pain and agony and also costs of the litigation.

Prayers  have been opposed by the counsel for OP.

The said plot admittedly is an industrial plot. Therefore, the plot being industrial in nature , the complainant is not a consumer as defined in the consumer protection Act. 1986. Therefore, the prayers of the counsel for  complainant are rejected on thsi ground . The complaint stands dismissed. Let a copy  of this order be given dasti to the counsel for parties. File be consigned  record room
