ORDER

Delay of 8 days condoned. 

Petitioner was living in Jhuggi No.A-488, Ambedkar Camp, Nehru Place, New Delhi.  On receipt of letter dated 21.04.2004 from respondent/authority, Petitioner filed a proposal-cum-request for allotment of an alternate plot after fulfilling the condition contained therein. Petitioner deposited the sum of Rs.14,000/-.  Respondent did not allot the plot.   Aggrieved against which, petitioner filed a civil suit which was subsequently withdrawn without seeking liberty to file a fresh suit or some other appropriate proceedings before any other forum. 

Petitioner filed a complaint before the District Forum which dismissed the complaint holding that mere completion of formalities does not create any right to the allotment of the plot in favour of the complainant. 

Petitioner being aggrieved filed a complaint before the State Commission which has been dismissed.  The State Commission has affirmed the order passed by the District Forum.

We agree with the view taken by the foras below that mere completion of formalities for making a proposal-cum-request does not create any actionable claim in favour of the petitioner.

Dismissed.  However, the petitioner if so advised, may seek his remedy in any other alternative forum.
