ORDER

 

The only prayer made in the application is for early hearing of the case. With consent of the opposite party, we allow the application and take up the complaint today itself for hearing.
On 12.11.2010, it was stated from the side of the complainant that the complainant has deposited the entire outstanding dues including the conversion charges and, therefore, the complainant was prepared to withdraw the complaint provided the respondent converts the said plot into a freehold plot. Counsel for the respondent sought adjournment to verify about the outstanding dues. Pursuant to that it is informed by Ms. Manika Tripathy, learned counsel for the respondent that the sum of Rs.8,80,300/- is payable by the complainant towards the conversion charges and once this amount is paid and the complainant furnishes completion certificate and ‘D’ Form, composition fee would be calculated. Mr. S.B. Sharma, under instruction, states that the complainant is prepared to abide by the said condition and he further states that certain challans of deposit of certain amounts have been submitted to the Accounts Department of the opposite party – DDA and the verification of the same is being made. Ms. Manika Tripathy, Advocate states that as soon as the same are submitted, the same will be verified and after the entire payment is made and other formalities are completed, the plot will be converted and order will be issued for converting the plot from leasehold to freehold.
In view of this understanding of the parties, we think that nothing survives in this complaint and the complaint is disposed of. Both the sides will discharge their obligations as stipulated in the order. No order as to cost in these proceedings.
