Mr. Joydeep Sarma, who has been engaged by the Complainant to prosecute the Complaint, states that as per his instructions, the Complainant is not interested in pursuing the Complaint against the present Appellant, namely, Porsche India, a division of Volkswagen Group Sales India Pvt. Ltd. In view of the statement on behalf of the Complainant, the cause of action, if any, qua the Appellant, leading to the present Appeal, does not survive. Consequently, the Appeal is disposed of as having been rendered infructuous. Needless to add that the statement made on behalf of the Complainant will have no bearing in so far as the Complaint against other Opposite Parties, as impleaded in the Complaint, is concerned. Since the Appeal has been disposed of finally in the above terms, interim order dated 10.10.2017 is vacated. Since the Complaint was filed as far back as in the year 2009, the State Commission is requested to take a final decision therein as expeditiously as practicable. The Appeal stands disposed of in the above terms. No costs. |
