By Smt. Rajani.P.S, Member: The case of the complainant is that the complainant had subscribed a 20th day monthly kuri conducted by the respondent on 20.7.2002. The total sala was Rs.84,000/- and Rs.2000/- was the monthly instalment amount. The complainant had paid 32 instalments and when he went to pay the next instalment the respondent stated that they are not receiving any kuri amount and are ready to return the paid amount of Rs.47,133/- upon the maturity date with interest. The complainant approached the respondent, as he hadn’t received any payment even after maturity. By his repeated demand the respondent returned Rs.11,000/- on different days and lastly he received Rs.3000/- towards arrear. No further payment done towards the kuri amount. So a lawyer notice was sent on 4.4.2008 but it was not accepted. Hence the complaint. 2. The respondents are called absent and set exparte. 3. To prove the case of the complainant he filed an affidavit and the documents produced by him are marked as Exts. P1 to P4. 4. According to the complainant he had paid 32 instalments for the kuri conducted by the respondent and further payment was not done that the respondents were not accepted any payment further and wanted to return the paid amount of Rs.47,133/- after the maturity period. On repeated demands the respondent paid Rs.11,000/- towards the kuri amount. No further payment was made by the respondents. 5. There is no counter evidence. 6. In the result, the complaint is allowed and the respondents are directed to return Rs.36,133/- (Rupees thirty six thousand and one hundred and twenty three only) with 9% interest from the date of complaint till realization with costs Rs.500/- (Rupees five hundred only) within one month from the date of receipt of copy of this order.
