The case of the complainant is as follows: On 15.6.2004 the complainant had joined one narukku kuri under statement No.17 in the 15th day monthly kuri conducted by the respondents. The kuri is having Rs.2,00,000/- as total sala and Rs.10,000/- as instalment trimonthly. The complainant had paid the said kuri for 4 instalments. When he has gone to pay for the 5th instalment the respondent stated that they are not receiving any payment further due to some issues in their institution. The managing director of the respondent institution assured that the paid amount of Rs.23,800/- will be returned when the kuri is matured. But never paid the amount so far. The complainant demanded the amount after the maturity date directly and finally demanded by sending a lawyer notice on 4.4.2008. But the respondent has not accepted the notice. Hence the complaint.

          2. The respondents are called absent and set exparte.

          3. To prove the case of the complainant he filed an affidavit and the documents produced by him are marked as Exts. P1 to P4.

          4. According to the complainant, he had joined a 15th day trimonthly kuri as per statement No.17 having a total sala of Rs.2,00,000/-. He paid Rs.23,800/- for 4 instalments. He could not continue the kuri payment further as the respondent informed him that the kuri can’t continue further as there is some issues in the respondent institution. The respondent assured him that the amount paid by him will return after the maturity date. But after the maturity the respondent has not returned the said amount. He is entitled to get Rs.23,800/- which he has paid for the kuri with 12% interest from 15.6.05 onwards.

          5. There is no evidence to the contrary.

          6. In the result, the complaint is allowed and the respondents are directed to return the Ext. P1 amount with interest at the rate of 9% per annum from 15.6.05 till realization with costs Rs.500/- to the complainant within two months from the date of receipt of copy of this order.
