ORDER

By Smt. Padmini Sudheesh, President The case of the complainant is as follows: The 1st respondent is a Private Limited Institution, which conducts kuri transactions and 2nd respondent is the Managing Director of the 1st respondent. The complainant had joined kuri in the firm and remitted Rs.6,102/- towards the kuri. Thus he had remitted the amount for 17 instalments. He could not remit the 18th instalment onwards due to non functioning of the firm. Hence he had demanded the amount and sent lawyer notice on 15/1/08. The respondent had accepted the notice but the amount had not returned so far. Hence the complaint. 2. The respondent is set exparte. 3. To prove the case complainant has filed affidavit and 4 documents which are marked as Exhibits P1 to P4. 4. According to the complainant he is entitled to get back the amount remitted and interest. He also claims for cost and compensation . 5. There is no counter evidence to the evidence of petitioner. 6. In the result the complaint is allowed and the respondent is directed to return the amount of Rs.6102/- (Rupees Six thousand one hundred and two only) with interest at the rate of 12% per annum from 15/1/08 and 6% interest from today till realization. The respondent is further directed to pay Rs.1000/- (Rupees one thousand only) towards cost. Comply the order within one month. Dictated to the Confdl. Asst., transcribed by her, corrected by me and pronounced in the open Forum this the 23rd day of October 2008.
