ORDER

By Smt. Padmini Sudheesh, President: Petitioner’s case is as follows: First respondent is the kuri company and second respondent is the managing director. Petitioner was a subscriber of 24th day kuri conducted by the respondents. The monthly instalment of the kuri was Rs.5000/- and the total sala was Rs.1,15,000/-. The petitioner joined this kuri on 24.8.04 and remitted the amount for eight instalments. The 8th instalment was paid on 11.4.05. When he has approached the respondents for remitting the 9th instalment, it was told that due to some problems the kuri amount is not receiving and assured that when the tenure of the kuri is completed, the entire amount paid by him will be returned. But it was not done. But on 5.7.06 a document is executed in favour of the petitioner by which they agreed to repay the amount by monthly instalments of Rs.500/-. Inspite of this, no amount is returned. So lawyer notice sent. It was acknowledged but no reply, no remedy. So this complaint is filed. The notice to the respondent from the Forum is returned as unclaimed. They willfully refused to accept. The lawyer notice addressed to the same address is accepted and notice from the Forum is also sent to that address. On 24.3.08 the respondents were called absent and set exparte. To prove the case of the petitioner he has filed affidavit and five documents. The documents are marked as Exts. P1 to P5. Heard the Counsel. According to the complainant, he is entitled for the amount remitted with 12% interest and costs. There is no counter evidence. So the petition is allowed and the respondents are directed to pay back the amount of Rs.32,186/-(Rupees thirty two thousand one hundred and eighty six only) with interest at the rate of 12% per annum from 11.4.05 till realisation and also to pay cost of Rs.500/- (Rupees five hundred only) to the petitioner. Time for compliance one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 12th day of May 2008.
