Case is called out.

Neither the appellant, nor his counsel is present.  On 11.01.2023, Smt. Seema Chauhan, learned counsel for the appellant was present.  On the said date, application on behalf of the appellant for effecting service of notice upon respondent by way of publication was moved, which was allowed and the appellant was required to take steps for service of notice upon respondent by way of publication, within two weeks’, fixing 07.02.2023 for further orders.

According to office report dated 23.02.2023, steps have not been taken by the appellant.

The appellant was also not present on the previous date, i.e., 07.02.2023, on which date, following order was passed by this Commission:

“Case is called out.

None is present on behalf of the appellant.

According to office report dated 07.02.2023, steps for publication have not been taken by the appellant.

In the interest of justice, one opportunity is provided to the appellant.

Put up on 23.02.2023 for further orders.  In the meanwhile, steps for publication be taken by the appellant.”

Inspite of that, the appellant has not taken steps.  No adjournment application has also been moved on behalf of the appellant.

It appears that the appellant is not interested in pursuing this appeal.

Accordingly, the appeal is dismissed in default of the appellant.
