SRI.P.V.JAYARAJAN : PRESIDENT
1. This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite parties. Even after accepting the notice the first opposite party not appeared before this commission and hence first opposite party was called absent and set exparte. Opposite parties 2 & 3 entered appearance and filed written version denying the allegations raised by the complainant.
3. When the case came up for consideration today both parties were present and filed a joint memo of settlement between the complainant and the second opposite party. As per the said settlement the second opposite party has agreed to pay Rs.4,50,000/- to the complainant towards the full and final settlement of the claim made by the complainant. The complainant has agreed to relinquish the entire further claim in view of the settlement arrived at between the parties to the proceedings. The joint memo of settlement is accepted and recorded.
In the result, the complaint is allowed in terms of the memo of settlement signed by both parties. The second opposite party is directed to deposit Rs.4,50,000/- before this commission within one month from the date of receipt of this order failing which the complainant is entilte to execute this order under due process of law.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
