The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986. The
facts as alleged in the complaint are that the complainant had purchased CP35031 Grey-Mega-3 Grey Mobile from the shop of OP-1 vide cash memo No. It has been further averred that the OP-1 assured the complainant at the time of purchase of mobile phone that all kind of defects such as Battery Swelled , touch screen etc. are within one year warranty from the date of purchase of the mobile phone and would be rectified immediately in any of their service centre all over India free of cost. The complainant further stated that mobile phone screen abruptly stopped functioning on 22.08.2017 and the matter was immediately reported to OP-1 and on its advice the mobile was handed over in the service centre i.e. OP-3 on 23.08.2017. On 29.082017 OP-3 demanded Rs. 36,00/- for rectifying the defects of the mobile which was unfair trade practice of the OPs because the mobile was under warranty period . However OP-3 arbitrarily kept complainant’s phone and did not return till 29.08.2017 which again was unfair trade practice. OP-3 did not bother to rectify the defects till date and thus the complainant is suffering due to non availability of mobile. The complainant has prayed for refund of the cost of mobiles Rs.75,00/- alongwith 18% interest with compensation of Rs. 15,000/- towards the physical strain and mental agony . He also sought costs to the tune of Rs. 25,00/- for petition.
2. Notice of the complaint was served upon OP-1 and OP-2 for 25.10.2017 but none appeared as a result both OP-1& OP-2 were proceeded ex-parte. OP-3 was failed to appear before fora on 15.01 2018 accordingly OP-3 also proceeded ex-parte.
3. We have heard the complainant and perused the record.
4. On 04.07.2017. The complainant appeared in person and statement that OP has already replaced the mobile phone with new one and that now he was only claiming compensation only towards harassment, inconvenience and litigation charges.
5. Needless to say that in present case the complaint was filed on 11.09.2017. The complainant has not informed the Forum as to on which date he got the new phone from OP. Admittedly the OPs have, in all fairness, replaced the old phone with new one. Not much harassment appears to have been suffered by the complainant. However keeping in view the acts and circumstances we are awarding a sum of Rs. 2,000/- to the complainant towards mental harassment and cost.
