              The Complainant files hazira. Hd. Ld. Lawyer for the complainant in the matter of admissibility of the complaint. Perused the complaint and the documents failed. The complainant said to have entered into an agreement with the Op to purchase a piece of land mentioned in the schedule of the complaint on payment of advance of Rs.1 lakh 50 thousand out of total consideration of Rs.7 lakhs. It is alleged that the Op. failed to execute the sale deed in terms of the agreement of sale nor refund the advance paid by the complainant in spite of repeated demands by the  complainant. Under the given facts and circumstances the complainant does not appear to be a consumer of the Op under Section 2(1) (d) of the Consumer Protection Act, 1986. As such the complaint is not admitted.
