An Application has been filed by the Jdr praying for exemption from payment of punitive cost imposed by the Forum. The said petition has been registered as MA 95/2018 and fixed today for hearing of the same.
Ld. Advocate for the Jdr. has submitted that by an Order dt. 17.02.2015 this Forum has directed in connection with CC Case No. 386/2014 upon the Jdr to pay punitive damages to the Dhr assessed at Rs. 100 per day for each day of non-compliance of the Order till realization and such amount shall be deposited in the SCWF. It is submitted by the Jdr that as per the Order of this Forum as well as the Hon’ble SCDRC the Jdr has complied the Order and prays for exemption from payment of punitive damages as above.
Hd. The Jdr. Peruse the petition and materials on record.
In view of the case of Rajeev Hitendra Pathak and other vs. Achyut Kashinath Karekar and Anr reported in (2011) 9 SCC 541 the District Forum has no power to review or recall of any Order passed by it, hence the petition of the Jdr is rejected.
The MA being No. 95/2018 is rejected and disposed of.
