Today is fixed for delivery of Order.

It is an application under Section 40 for review of the ordering portion of the Judgment passed in RBT/CC/189/2019 on 24.09.2020. The Applicant who is the Dhr has pointed out that the ordering portion of the aforesaid Judgment is tended with some errors.

The Ld. Advocate appearing for the applicant has submitted that although the Op 1(a) and 1(b) are jointly and severally liable to execute the Deed, they have jointly been made responsible for doing so. He has also pointed out that the Case was heard ex parte as against the rest Ops, but the order dismissing the Case as against the rest Ops erroneously recorded. Substances in the aforesaid contention of the Ld. Advocate is found correct and therefore it is directed that Op 1(a) and 1(b) will jointly or severally execute the Deed in question and the Case as against the rest Ops allowed ex parte.

The remaining portion of the Order impugned will remain unchanged. This Order may part of the Judgment passed in the Complaint Case no. RBT/CC/189/2019 dt. 24.09.2020.

The Review Application being no. RA/04/2020 is thus disposed of.
