            The complainant is present through his Ld.  Advocate by filing hazira.  Today is fixed for admission hearing.  Today the complainant has filed amended complaint showing amendment in the cause title of the complaint.  It is seen by us that C.C. No.57/2017 has not yet been admitted, hence, in this juncture amendment in the complaint or in its cause title cannot be allowed.  Under the situation the complainant has prayed for dismissal of the instant complaint giving him liberty to file afresh stating the same averment.  In our view in the greater interest of justice the complaint is allowed either to not press the complaint or to get a dismissal order.  As the complainant did not put endorsement as not press and inclined to get an order dismissing the complaint hence, we are of the view that as the amendment cannot be encouraged and allowed as per settled law the complaint being No.57/2017 is hereby dismissed without being admitted.  However, the complainant is at liberty to file afresh stating the same averment, if any.  The office is directed to return the requisites as filed by the complainant for service of notice upon the O.Ps. forthwith.  Hence, it is

 that the C.C. being No.57/2017 is hereby dismissed without being admitted.  There is no order as to cost.

Let the copy of this order be supplied to the complainant free of cost.
