None is present for both the parties. The perusal of R&P shows that Adv.P.V.Shinde had appeared for the appellant on 15/7/13. However, thereafter, though the appeal came to be adjourned thrice, none appeared for the appellant. Appellant has also not taken steps to serve notice to the respondent though direction was given to he appellant from time to time. Therefore, the appeal deserves to be dismissed. Appeal be recalled at 3.00 p.m. for order.

The matter is recalled at 4.30 p.m. today. Presently also none appeared for the appellant. Hence the appeal is dismissed in default.
