1.      We heard Adv.Mangesh Patel counsel for appellant in respect of condonation of delay application MA 725/09. There is a delay of 88 days in filing the appeal. In the condonation of delay application, various grounds have been mentioned by the appellant. But these grounds do not appear to be just and reasonable. Hence we do not think this to be a fit case to condone the delay.

2.      Finance companies like the appellant should be more diligent in filing appeal. For filing appeal a period of 30 days from the receipt of order is prescribed. After exhausting 30 days period, there is a delay of 88 days additionally, which is not properly explained by the Appellant Company and, therefore, we are not inclined to condone the delay though Respondent is not present.  In the result, we pass the following order…

ORDER

      The application for condonation of delay bearing No.MA/725/09 stands  

      rejected. In the consequence, appeal No.A/09/695 as well as application for  

      interim relief bearing No.MA/726/09 does not survive for our consideration.
