None is present for the appellant.  Adv. Mr D B Mungle is present for the respondent. He already filed Pursis on 10.12.2013 stating that the respondent died on 10.11.2011.  However, the appellant has not taken any step till this date for brining his LRs on record.  The record also shows that this Commission issued notice to the appellants on 04.09.2013 on their same address given in the appeal memo.  Though no report about service of that notice is received, we presume that it is duly served to them.  As the appellants are absent and they have not taken any step to bring the LRs of deceased respondent on record, the appeal deserves to be dismissed in default.  It be recalled at 3.00 p.m. for order.

The appeal is recalled at 3.00 p.m. for order.  Presently also none appeared for the appellant. 

Hence, the appeal is dismissed in default.
