Sh. M.K. Kohli, learned counsel for the revisionist is present. None appeared on behalf of the opposite party.
This revision petition has been preferred by the revisionist against the impugned order dated 17.08.2010 passed by the District Forum, Dehradun in Execution Petition No. 11 of 2005, thereby the District Forum has issued a recovery warrant against the revisionist for a sum of Rs. 10,990/-.
Despite of opportunity given to the opposite party, none appeared on behalf of the opposite party.
On 22.04.2016 & 08.08.2016, the case was adjourned with a note that in case the opposite party does not appear on the next date fixed, then the matter shall be heard and decided in his absence.
Today, we heard Sh. M.K. Kohli, learned counsel for revisionist.
This fact is not disputed that the disputed amount was deducted towards TDS. The said amount has been deposited by the revisionist with the Income Tax Department, therefore, the impugned order is liable to be set aside.
Revision petition is allowed. Impugned order passed by the District Forum is set aside. No order as to costs.
