Complainant is absent without steps.

It appears from the case record that the complainant namely Smt. Pushpa Sarkar filed a complaint before this Commission against the ops praying directions as incorporated in the prayer portion of the complaint petition and on the basis of that complaint petition a C.C. case being no. 13 of 2020 being instituted vide order dt. 17.02.2020. it is pertinent to that the complainant during the period of filing filed a demand draft of Rs. 200/- being no. 895226 dt. 14.02.2020 of SBI, Serampore Branch.

 During the period of lockdown the Registrar-in-charge could not send the above noted bank draft to the concerned bank branch due to shortage of staff as a result the said bank draft became stale. So, this Commission vide its order dt. 8.12.2020 directed the complainant to take back the original bank draft and to file a fresh draft by next date but the complainant since 1.10.2020 is absent without steps. A several adjournments granted for filing a fresh draft but the complainant bothered to take any steps on that score.

As a result this Commission is in the opinion to dismiss the above noted C.C. case for non prosecution as the complainant is not interested to proceed the case and in the same parlance the Registrar-in-charge is also directed to be cautious enough for encashing such draft as early as possible so that no such occurrence may take place in further.

Hence ordered that the C.C. case being no. 13 of 2020 be and the same is dismissed due to non prosecution.
