ORDER

He has filed his memo of appearance on behalf of Ops No.1 to 3.

                                    There is pending application of complainant dated 05.07.2022 seeking restraining order against the Ops not to effect recovery of Rs.87955/- from the complainant. Qua this application, learned counsel for complainant submitted that he wants to withdraw it because electricity connection has already been disconnected by the Ops at the premises of the complainant about two days back during pendency of the present complaint. The main relief sought in the main complaint is almost the same as mentioned in the application. For these reasons, learned counsel for complainant wants to withdraw the main complaint as well as the application with permission of this Commission to file it afresh on separate cause of action in near future. Learned counsel for Ops has no objection to these submissions. Separate statement of learned counsel for the complainant also recorded today. In view of such statement and submissions of both sides, present complaint alongwith application disposed of as withdrawn with liberty to complainant to file it afresh in near future on separate cause of action and benefit of period of limitation also allowed in favour of complainant as per mandate of judgment of Hon’ble Supreme Court given in Laxmi Engineering Works versus PSG Industrial Institute  (1995) 3 SCC page 583 , File be consigned to the record room, as per rules, after necessary compliance.
