Learned counsel for the petitioner submitted that in the light of judgment of Honle Apex Court in the case of U.P. Power Corporation Ltd. & Ors. Vs. Anis Ahmad, the matter may be disposed of with liberty to approach to the appropriate authorities. Complainant/Petitioner filed complaint before District Forum and challenged bill raised by the opposite party/respondent on the basis of meter checking conducted in the presence of complainant. District Forum allowed the complaint but learned State Commission, vide impugned order dismissed the complaint as complainant was not a consumer. In the light of judgment of Honle Apex Court in Anis Ahmad case, complaint filed by the petitioner was not maintainable before the Consumer Fora and petitioner should have approached to the appropriate authority under the Indian Electricity Act. In such circumstances, revision petition filed by the petitioner is dismissed with liberty to the petitioner of seek Redressal of his grievance before appropriate Fora under the Indian Electricity Act.
