Case called out repeatedly. Complainant is absent. Opposite party is present through Counsel. Notice was sent to the complainant after transfer of this case from the District Forum-II but, none has turned-up on behalf of the complainant. The Learned Counsel for the opposite party has filed copy of F.I.R. dated 28/03/2008. He has already filed his written statement and averred that, this is a case of theft of electricity, therefore, this Forum has got no jurisdiction to entertain the present case. Photo-copy of the F.I.R. goes to show that, a case under section 135     has been registered against the present complaint therefore, in view of the principle of law laid down in U.P.Power Corporation V/s Anis Ahamad 2013 (3) C.L.T. 226 the present case is not maintainable before this Forum. The present complaint is dismissed. Both the parties shall bear their own costs.
