Brief Facts of the case
This consumer complaint has been filed by Mr Chander Mohan, a complainant for getting correct water bill from OP along with compensation. The facts were that complainant was not getting water bill regularly though he was paying water bill regularly up to May 2012.
Complainant was surprised to see next bill having a sum of Rs 69582/-. He immediately inquired from OP office but did not get any satisfactory reply from OP office. So he decided to file this complaint with all the water bills he had.
After scrutinizing facts of the complaint and annexures, notice was served. OP put up his appearance and filed written statement denying all the allegations of wrong bills. OP stated that the complaint was not signed by the complainant and thus the same to be dismissed. The complaint had been signed by Madhubala who has no locus standee to file this complaint. OP had also submitted affidavit of Mr Jagdish Maurya, an authorized person of OP. He had submitted the complainant has four stories house having many families residing in it and complainant has only one connection of water. They had never applied for another water connection in their name.
More so, the OP had not issued regular water bill due to their administrative setup but every months an ad-hoc bills were issued but complainant was not paying bills irregularly. Once bill was not paid on due date, surcharges added in all the subsequent bills. OP submitted the last outstanding bill having arrears and dues of Rs 178289/-up to 21/02/2016.
After Govt. water policy, all the arrears up to Rs 113303/- were adjusted and the final outstanding bill of Rs 15832 was due on complainant which he had to pay up to 09th Mar. 2016. OP submitted that the same amount was paid by the complainant on 27/02/2016.
OP submitted that the demand of complainant had been resolved accordingly. Both the parties submitted their evidences on affidavit. Arguments were heard and order was reserved.
We came to the conclusion that OP had issued earlier water bills on ad-hoc basis but the regular actual bills were not issued. The submission of facts of OP were also considered which they took in their stand that ad-hoc bills used to be issued only in unavoidable situations, but in regular bills all actual charges and arrears were added. Complainant had only prayed for waiving of all the arrears and OP to issue correct and regular water bills. During arguments, complainant was satisfied by getting correct bill.
Considering the merit and evidences as per the complaint, both the parties had no issues pending. Considering written statement and affidavit of OP that the said premises is having four storey and only one regular residential water connection, the water bill be again on higher amount because, the existing scheme if goes out, water charges would be higher.
After considering all the evidences, we came to the conclusion that genuine complainant had not signed the complaint so complaint required to be dismissed with a direction to have appropriate water connection floor wise so that he should not face any inconvenience in future in paying the water charges.
The complaint is dismissed with direction to complainant without any cost.
The order copy be sent to the parties as per act and file be consigned to the record room
