ORDER

BY Mr. K. B. SANGANNANAVAR: Pri. Dist. & Session Judge (R)- JUDICIAL MEMBER:

  1. This Review Petition is filed U/s 50 of Consumer Protection Act, 2019 to review the order dated 06.07.2023.  Having heard learned counsel for RA, found that some clerical error crept in the order dated 06.07.2023 passed by this Commission.  As such acting U/s 50 of Consumer Protection Act, 2019 ordered to rectify the figure in para-10 as Rs.5,53,890/- in place of Rs.4,00,338/-.  Accordingly, ordered to add the para-10(a) after para-10 in the order dated 06.07.2023 as follows:

“OP insurer is entitle to deduct Rs.5,53,890/- w.e.f. 26.10.2017 and directed to indemnify the complainant for the remaining balance amount along with interest @ 08% p.a. from the date of complaint till realization and do pay Rs.25,000/- towards pain and sufferings and Rs.5,000/- towards litigation charges within 45 days, failing which such amount shall carry interest @ 09% p.a. from the date of complaint till realization.”

  1. The request of RA Petitioner to reduce rate of interest from 08% to 06% is hereby rejected.
  2. This order is directed to be part and parcel of the order dated 06.07.2023.
  3. Notify free copy of this order to the parties and notify the copy also to the District Commission.
  4. The Amount in deposit is directed to be transferred to the Commission below for needful.
