Arguments on the point of admissibility heard.
The complainant has filed the present complaint against the opposite party on the ground that he has applied for second hand car loan in Jan, 2016 which was rejected on the ground of CIBIL rating and the CIBIL has given wrong rating and CIBIL was negligent in not giving appropriate rating and on account of credit rating the loan of the complainant was rejected by the financial institution and as such the complainant be awarded the amount of Rs.,90,000/-along with interest on account of damages caused to him.
However, after going through the facts and circumstances of the case we are of the considering opinion that the complainant is not a consumer qua the opposite party. There is no contract between the complainant-consumer and the opposite party. No consideration has been paid by the complainant to the opposite party. The opposite party is independent/autonomous credit rating agency. Therefore, the complainant is not a consumer of the opposite party as defined u/s 2(1)(d) of Consumer Protection Act, 1986 and thus, for want of status of the complainant the complaint itself is not maintainable before this Forum and the same is hereby dismissed. A copy of this order be supplied to the complainant free of costs.
File be consigned to the records after due compliance.
