The fact in brief is that the complainant had purchased one Scooty bearing registration No. ORI 0594 on 24.11.12. The invoice for Rs.42,539/- alongwith registration invoice for Rs.4,851/- is annexed with the complaint. Complainant alleges that the vehicle started giving problem from the very beginning. The vehicle did not use to start immediately and even the self start was not working. The engine of the vehicle was making sounds during shifting of gears. The average per liter of the vehicle was much below the expected mileage. Complainant thereafter made several complaints to authorized service centre but the defects were not rectified. Complainant further imputes that the shocker, mud guard, mirror were not changed and every day a new problem was being faced by him. It was stated that during his many visits, engine oil and other small parts were changed but no major rectification was however done. Thereafter complainant filed a complaint praying that defective vehicle should be taken by the OP and invoice amount be paid alongwith compensation and interest.
Notice was sent to OP but none appeared on behalf of OP. Hence OP was proceeded exparte on 08.05.14.
We have considered the arguments placed by complainant alongwith pleadings. Complainant has filed a copy of invoice amount, delivery challan and the received from OP. However, complainant has not filed any jobsheet or any correspondence with OP wherein the vehicle had been taken for repair or has/has not been repaired. Complainant has not been able to prove that he has taken his vehicle for repair even or he had faced any problem in the aforesaid vehicle. No reasonable consumer complaint is made out on the basis of mere conjectures on vague allegations. Hence the complaint is dismissed.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
