ORDER

President: Ms. Monika A Srivastava

It is the case of the complainant that she purchased jewellery set from the OP-2 and in lieu of that purchase certain points were provided by OP-2 for purchase from OP 1.

The complainant redeemed 28756 points provided by OP-2 against Order No. B1832D7A and 8299 points against the Order No. EDA1B806 when she purchased jewellery from OP-1. The complainant further received 1438 points against her Order No. B1832D7A and 1443 against Order No. EDA1B806 this time from
OP 1. The complainant again ordered vide Order No. Q0272446
on 13.10.2020 against her exclusive points provided by OP-1. The product value was Rs.2,816/- but OP-1 denied to redeem all the points and her order was cancelled as OP-1 redeems either Rs.500/- or 10% of the value of the product.

It is the case of the complainant that while she can redeem full points in one shot from OP-2 but she is not able to redeem full points from OP-1 and that she has sent her grievance through what’s app and also e-mailed but did not receive any reply. It is further the case of the complainant that there is deficiency in service on the part of the OP which has caused mental and physical harassment to the complainant.

This Commission is of the view that no case of deficiency in service is made out against the OP as it is the product which is purchased and the points are offered only as an incentive for the customer to purchase again. The future redemption of points while making another purchase is always subject to the terms and conditions of the OP. The OPs are not selling the points but are merely selling jewellery and alongwith that points are offered. The complaint is dismissed in limine as no case is made out against the OP.

File be consigned to the record room after giving copy of the complaint.
