Sh. B.D. Pande, learned counsel for the appellant is present.

An application has been moved on behalf of the appellant, stating therein that both the parties have resolved their dispute and respondents have reimbursed the principal amount of Rs. 1,49,025/- (Rupees One Lac Forty Nine Thousand Twenty Five Only) to the appellant, hence the appellant wants to bring an end to the litigation.

Learned counsel for the appellant states that in the light of aforesaid compromise entered between the parties, the appellant wants to withdraw the appeal.

Learned counsel for the appellant has also endorsed on the order-sheet that he does not want to press this appeal.

Accordingly, the appeal is dismissed, as not pressed.
