1. Complainant is aggrieved that opposite party refused to replace the shirt purchased from opposite party shop for Rs.220/-. It is his case that after reaching home he found that the shirt was not his correct size.
2. Notice was issued to opposite party. Opposite party remained absent even after receiving the notice. The acknowledgement card returned to the Forum bears the seal of opposite party shop. It is clear that notice was properly served. Opposite party being absent was set exparte on 26-10-2009.Complainant filed affidavit on 12-11-2009 restating the averments in the complaint. Ext.A1 is the bill which shows the price of shirt as Rs.220/-. MO1 is the shirt produced before the Forum. There is no contra evidence. Claim proved. Complaint allowed and opposite party is directed to refund Rs.220/- (Rupees Two hundred and twenty only) to the complainant along with costs of Rs.100/- (Rupees One hundred only) within one month from the date of receipt of copy of this order. On payment the MO1, shirt shall be returned to opposite party on his making an application for the same. Dated this 13th day of November, 2009.
