The Complainant filed present complaint against the opposite party for not transferring balance amount of NEFT amount to Rs.57,602/- which was wrongly transferred by opposite party No.1 and 2 and therefore claiming compensation of Rs.25,000/- along with interest and Rs.15,000/- for cost of litigation.

2. The complainant is running a business namely Girnar Optical , for earning his livelihood  having current account no.37603895391 with O.P. No.2. The complainant on dated 18.3.2019 transferred Rs.2,00,000/- by NEFT to Mayur Optical at New Delhi bearing account No.02050160100534. The Mayur Optical was having its current account with O.P. No.1 Bank UTR No. for NEFT was SBIN819077813837, but due to mistake of O.P. No.1 & 2 the amount has been credited in the account of Water Galen company of Mr.Bhatia bearing account No.020501601000536 instead of the account of Mayur Optical.

3. The complainant made the application for retransfer of wrongly credited amount, hence the O.P. Nos.1 and 2 redeposited in the       complainant account Rs.1,42,398/- but fail to deposited Rs.57,602/-.  The complainant issued reminder by E-mails from last 2 years and therefore issued legal notice on 29.3.2021 but O.P. Nos.1 and 2 fail to comply the notice. Therefore present complaint is filed before this Commission.

4. The O.P. Nos.1 and 2 have been served but fail to appear before this Commission. Hence complaint is proceeded exparte against the O.P.Nos.1 and 2 as per order dated 4.10.2022.

The amount of NEFT of Rs.2,00,000/- has been wrongly credited in the account of Water Galen company of Mr. Bhatia bearing account No.0205016000536 instead of Mayur optical bearing account No. 02050160100534. Therefore the complainant requested the O.Ps.  to retransfer the amount in his account. Thereafter O.Ps. credited Rs.1,42,398/- but fail to deposited Rs.57,602/-. Therefore complainant moved various request of retransfer and thereafter on 29.3.2021 issued legal notice to return the balance amount of Rs.57,602. The non transfer of balance amount in complainant account does amount to deficiency in  service on the part of O.Ps. Therefore complaint is partly allowed. The O.P.No.1 and 2- Bank is directed to refund the balance amount of Rs.57,602/- in complainant Bank account alongwith compensation of Rs.10,000/- for physical and mental harassment caused to the complainant & cost litigation as  per following order.

ORDER

1.         Complaint is partly allowed.

2.         O.P.Nos.1 & 2 is directed to refund the balance of Rs.57,602/- by crediting the amount in complainant Bank account.

3.         O.P.Nos.1 & 2 are hereby also directed to pay to the complainant compensation  of  Rs.5,000/- each  towards physical and mental harassment caused to the complainant & cost of            litigation

4.         Copy of order be furnished to both the parties free of cost.
