The complainant is present by filing hazira.
The case is fixed for filing W.V I/d exparte hearing. No W.V has been filed by the O.P. So the case is taken up for exparte hearing.
The complainant’s case is that she purchased a PET Blowing machine with air drawer machine for Rs-843700/= including GST under invoice No-21-22/179 dated 22-02-2022 issued by O.P and paid additional sum of Rs-500000/= under an agreement of sale executed by and between the parties on 18-02-2022. The complainant paid the entire money to the O.P which is evident from the bank statement and agreement of sale. At the time of installation said machine cropped up a problem which could not be solved even by the technician of the O.P Company who visited the installation site thrice. Thus the complainant cannot operate the newly purchased machine for non installation of the same and as such she had suffered a huge pecuniary lose in her business.
The complainant has therefore approached the commission for refund of Rs-1343700/= towards the cost of the defective machine with compensation and litigation cost.
The commission exhausted all the process for the service of the notice upon the O.P by speed post but was in vain. Ultimately notice was sent to the O.P via Email on 23-06-2023. Despite service of notice through electronic device the O.P did not turn up and contest the case by filing any W.V.
At the time of hearing the complainant has proved all the relevant documents in support of her case. Prima facie case of the complainant is established to the hilt.
The complainant is entitled to get the relief as prayed for.
Hence it is ordered.
That the case is allowed exparte against O.P with cost Rs-1000/=.
The O.P is directed to pay to the complainant Rs-1343700/= as the price of the defective machine with compensation of Rs-200000/= and litigation cost of Rs-10000/= within a month from this date in default law will take its own course. On payment of entire decretal amount complainant will hand over the defective machine to the O.P.
Both parties be supplied copy of the order free of cost.
