JUDGEMENT

            Complainant Sumit Kumar Padhy has filed this case U/S 35 of the CP Act 2019 alleging deficiency in service for not providing him with the Mark Sheet and Final Certificate of MBA Course (3^rd and 4^th Semister) and praying therein for direction to the Opposite Party to provide with the Mark Sheet and Final Certificate of MBA Course.

1. Brief Fact leading to the case is that the complainant was a student under Distant Education Mode of Punjab Technical University. Even though he appeared and completed 3^rd and 4^th Semister and successfully passed the MBA Course, his Mark Sheet and Final Certificate of 3^rd and 4^th Semister were not issued to him in spite of repeated approaches for which he has filed this case before this Commission for the reliefs as discussed above.
2. After receipt of notice, the Opposite Party did not appear, but filed his show cause in form of letter address to the Bench Clerk of this Commission. In his letter, JKGPTU/COE/12841 dt. 24.11.2022 that the complainant cannot be provided with 3^rd and 4^th Semister and Final Certificate of MBA as he has not cleared the University Fees of 3^rd Semister.
3. During the course of hearing, the complainant submitted that he had paid the fees to the local office of the Opposite Party of Phulbani. But to avoid further delay, as it involves his carrier, he is ready and willing to pay the fees for 3^rd Semister to avoid further delay in getting his Certificates and Mark Sheets. Since this is the only part of  dispute and the complainant is willing to pay the University fees for the 3^rd Semister and the Opposite Party has already given his consent to provide the Mark Sheet and Certificate, we do not want to proceed further on the point of deficiency in service and hence the order.

O R D E R

            The complaint petition is disposed of with a direction to the complainant to pay the University Fees for 3^rd Semister of MBA Course within a period of 10 days from the date of receipt of the order and the Opposite Party is directed to issue the Mark Sheet for the 3^rd and 4^th Semister along with the Certificate on receipt of the fees for 3^rd Semister within a period of 15 days from the date of receipt of the fees from the complainant bearing the Roll No. 12220590002. Parties to bear their own cost.
