            This is an appeal filed under Section-15 of the Consumer Protection Act, 1986 against order dated 22-07-2017 passed by the District Consumer Forum, Mahoba in Complaint Case No. 57/2016 Indresh Mohan Dutta Tiwari V/s Controller of Examination, U. P. Rajarshi Tandan pen University, Allahabad and others whereby the District Consumer Forum has dismissed complaint in default of complainant.

            Feeling aggrieved with the order passed by District Consumer Forum, the complainant has filed this appeal before State Commission                             Learned Counsel Mr. Santosh Shukla appeared for the appellant.

  I have heard learned Counsel for the appellant and perused impugned

order as well as complaint.

Perusal of impugned order shows that complaint has been dismissed in default of complainant but the averment made in complaint shows that the complaint has been filed for redressal of grievance arising out of examination and issuance of mark sheet.

Considering all the facts and circumstances of the case, the appeal is allowed. The impugned order passed by the District Consumer Forum is set aside and the case is remanded to the District Consumer Forum with direction to decide first as to whether the complaint is maintainable under the Consumer Protection Act 1986.

The maintainability of complaint shall be decided by the District Consumer Forum after giving an opportunity of  hearing to the complainant.

Complainant shall appear before District Consumer Forum on 04-10-2017.
