          The case of the complainant in short is that complainant gave his Samsung LCD TV for repairing to o.p. on 28.6.12 and the said TV was returned on 10.7.12 with poor picture quality. After several calls the technician never came to see the problem. Within a few days of delivery of TV was showing some problem which o.p. repaired. The technician did not turn up even after so many calls. At last a person came and took the TV for repairing once again. But the said TV has not been returned to the complainant nor refund the money and all the time simply asking for more time. Hence the case was filed by the complainant with the prayer contained in the petition of complaint.

            Sole o.p. did not appear and contest the case by filing w/v and matter was heard ex parte against the o.p.

Decision with reasons:

            We have gone through the pleadings of the complainant, evidence and documents in particular and we do not find the receipt of purchase of the TV on record and without the said receipt the case of the complainant cannot be substantiated. That being the position we are constrained to hold that the complainant has failed to substantiate and prove his case and is not entitled to relief.

            Hence, ordered,

            That the case is dismissed ex parte without cost against the o.p.
