Case called out.  Learned counsel for both the parties are present. 

Learned counsel for the complainants has moved substitution application that one of the complainant, complainant No. 5 Sh. Reginald Cyril Dennis, has expired on 24.01.2014, copy of death certificate filed, therefore, the complainants may be permitted to amend the consumer complaint.

Learned counsel for the opposite parties has no objection against this substitution application. Therefore, the amendment application is allowed. Learned counsel for the complainants is directed to incorporate the proposed amendment in the present consumer complaint.

Learned counsel for the complainants Sh. T.S. Bindra, Advocate has filed photocopy of Power of Attorney of complainant No. 4 Mrs. Enid Nirmala Elmagboul in favour of Mrs. Manisha Johri.  The same be placed on record.

Learned counsel for the opposite parties Sh. M.K. Kohli, Advocate has filed two Power of Attorneys, one by opposite party No. 1-Conscient Infrastructure Pvt. Ltd. in favour of Sh. Sanjay Rastogi and the other Power of Attorney by M/s Mussorriee Himalayan Resorts Pvt. Ltd. in favour of Sh. Sanjay Rastogi.  The same be also placed on record.

Learned counsel for both the parties have filed a joint compromise to dispose of the present consumer complaint in terms of the compromise and this compromise forms a part of the order passed by this Commission.

The complainant No. 1 Sh. Jagdish Balooni, Vice President, Arborea Luxury Homes Residents Welfare Society; complainant No. 2 Ms. Maya Lydia Norula; complainant No. 3 Sh. Anil Sawhney; complainant No. 4 Mrs. Enid Nirmala Elmagboul through her Power of Attorney Mrs. Manisha Johri; complainant No. 6          Sh. Vijay Pradhan and complainant No. 7 Sh. Rajesh Kumar Dudani are present in person before this Commission.  Signatures of these complainants have been identified by their counsel Sh. T.S. Bindra, Advocate.

Sh. Sanjay Rastogi, Power of Attorney of opposite party No. 1 Conscient Infrastructure Pvt. Ltd. and opposite party No. 2 M/s Mussorriee Himalayan Resorts Pvt. Ltd. is present before this Commission, whose signature is identified by learned counsel for the opposite parties Sh. M.K. Kohli, Advocate.

The compromise is accepted. Case is decided in terms of Compromise.  This compromise shall be the part of the order
