Heard the Ld.Advocate for the Complainant. Perused the complaint and papers attached to the complaint. It appears that the cause of action took place in the month of June, 2006 when the Complainant received letter dtd.01/06/2006 from Opposite Party No.2. It is submitted by the Ld.Advocate for the Complainant that, the Complainant from time to time contacted the Opposite Party and Opposite Party assured to the Complainant that they would reconsider the mater. The Ld.Advocate has relied on the letter dtd.08/07/2009. However, it appears from the contents of the letter that Opposite Party has specifically stated that after 08/11/2006 there is no correspondence between the parties and vide letter dtd.01/06/2006 they have informed their decision. The complaint is not filed within 2 years from the date of cause of action i.e. from 01/06/2006. Complaint is filed before this Forum on 03/06/2001 which is hopelessly time barred. There is no application for condonation of delay. Hence, complaint is dismissed as barred by law of limitation. No order as to cost.
