By Jayasree Kallat, Member<br /> <br /> The complainant has filed this petition seeking relief alleging unfair trade practice on the part of opposite party and that the opposite party has not given the offered gift of an Oven while buying a Laptop from the opposite party. Opposite party had advertised in the Mathrubhoomi daily on 24th August 2007, that those who buy a Lenovo Laptop will get a Microwave Oven free. The notice was issued to the opposite party, they have not appeared. Again on 29-5-08 opposite party was represented through an agent. But for the subsequent posting opposite party was not present. Hence warrant was ordered to be issued to opposite party, even though the notice was served to opposite party, opposite party did not appear. Hence the opposite party was set exparte on 18-9-08. The complainant had filed affidavit and examined as PW1. Exts.A1 to A3 were marked on complainant’s side. From the evidence and Ext.A1 to A3 the case of the complainant is proved.<br /> <br /> In the result the petition is allowed and the opposite party is directed to give the Microwave Oven as offered in the Ext.A3 advertisement or to pay an amount of Rs.3000/- and a cost of Rs.500/- to the complainant within 30 days from the date of re ceipt of this order.<br /> <br /> Pronounced in the open court this the 6th day of October 2008.<br /> <br /> Sd/- Sd/- Sd/-<br /> PRESIDENT MEMBER MEMBER<br /> <br /> APPENDIX<br /> <br /> Documents exhibited for the complainant.<br /> <br /> A1.
