ORDER

                The case of the complainant is that he is having reliance Digital TV Connection vide Smart Card No.2000967859602.  The complainant got recharged this connection on 27.10.2014 for a period of one year.  Before recharging an amount of Rs.7/- was standing as credit in the account of the complainant and nothing was outstanding against his account.  The service was restored on 28.10.2014 and on 29.10.2014 at about 6.00 PM all of a sudden the service was disconnected by the OPs without giving any notice to the complainant.  When the complainant requested the OP about disconnection of the service, he was informed that there was mismatch with the set up box number and Rs.400/- are to be deposited by him, which the complainant deposited on 11.11.2014. However, inspite of this, the service was restored on 17.11.2014. The OP is also deducting service providing charges on daily basis and has also deducted Rs.100/- for subscription of movie whereas the complainant has never asked for any movie.  In this way the complainant has been denied uninterrupted enjoyment of the service of TV.  Thus, the complainant has sought direction to the OP to compensate him.

2.             The OP in the reply has averred that all the complaints of the complainant are through e-mails. The OP is a voice based call centre of Reliance Digital TV and does not deal with e-mail queries.  The queries of emails are handled by the nodal office of Reliance Digital TV, Rajiv Gandhi IT Park, Chandigarh.  The OP has forwarded the notice to Nodal Officer, IT Park, Chandigarh.

3.             Evidence of the complainant consist of his affidavit Ex.CW-1/1 and copies of documents Ex.C-1 to C-3.

4.             Evidence of the OP consists of affidavit of Prem Misra, its General Manager Admn. and Legal Ex.OP-1/1.

5.             We have heard the complainant and authorized representative of the OP and gone through their written arguments.

6.             The dispute is regarding over charging of the digital TV connection Smart Card No.2000967859602. As per the complainant without any default on his part the services were discontinued by the OP on 28.10.2014 and when approached the OP they demanded some Rs.400/- as charges for setting the correct box number. The complainant has deposited the same on 11.11.2014 and still the OP restored the services on 17.11.2014 after delay of six days and besides without any subscription of movie channel, the OP is deducting Rs.100/- on daily basis from the account of the complainant.  Regarding his grievance as per the complainant he has informed the OP through e-mails and still his grievance has not been redressed. Therefore, he has alleged deficiency in service on the part of the OP.

7.             The OP has admitted its role as a service provider of Reliance Digital TV but has confined its role as a call center i.e. the voice based call center. The OP has denied having received any complaint on voice based call center from the complainant.  We have perused the evidence Ex.C-1 and C-2 i.e. the e-mails exchanged between the complainant and Officer Customer Care Reliance Digital TV.  The perusal of Ex.C-1 clearly shows that the service was disconnected by the OP due to insufficient balance and the Customer Care Reliance Digital TV has duly informed the complainant to recharge his account with Rs.250/- keeping the set top box on which shows that the complaints have been duly attended to by the Customer Care Reliance Digital TV, who is not a party before us.

8.             As the complainant cannot take benefit of his own wrong, i.e. insufficient balance maintained by him and cannot put the onus on the OP for not providing proper and effective service.

9.             Thus the complaint being devoid of any merit is hereby dismissed with no order as to costs. Certified copies of the order be furnished to the parties forthwith free of cost and thereafter the file be consigned to the record room.
