ORDER

By Smt. Padmini Sudheesh, President: The petitioner’s case is as follows:- The petitioner had joined for D.M.L.T. course in the respondent institution on 1.8.2006. She had remitted Rs.27,000/- for tuition fee, admission fee, P.T.A. fund and caution deposit at the time of admission. She is availed admission there and had provided admission card and bus concession card. The petitioner discontinued from the respondent institution on 1.9.06 as she got admission for another course ie. B.P.T. Physiotherapy at Calicut, which is having higher vocational chances. She received T.C. from the respondent institution. At this time the petitioner demanded for the amount she had paid at the time of admission. But the respondent did not return any amount but T.C. only. The petitioner is from a poor family background. She is continuing her studies by taking educational loan from State Bank of Travancore, Thrissur Subway Branch. The petitioner sent a lawyer notice for demanding the above said amount. But the respondent neither given a reply nor money. The respondents called absent and set exparte. 2. To prove the case of the petitioner, the petitioner has filed an affidavit and the documents produced by her are marked as Exts.P1 to P6. 3. Heard the Counsel. 4. According to the petitioner she is entitled to get back the amount ie. Rs.27,000/- with 12% interest. She also claims compensation and costs. There is no counter evidence. 5. So the petition is allowed and the respondents are directed to return the amount of Rs.27,000/- (Rupees twenty seven thousand only) with interest at the rate of 12% per annum from 1.8.2006 till realization and Rs.500/- (Rupees five hundred only) as costs to the petitioner. Time for payment one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 16th day of May 2008.
