Brief facts of the case:-

Case in hand is the allegation of  deficiency in service and unfair trade practice by the O.Ps  for  non refund of deposited amount  Rs. 2,25,000/- which  the complainant sought  redressal.

On being noticed the O.P. No. 1 appeared through their learned counsel and field written version. The O.P No.2  not appeared though notice has been  duly served resultant made exparte.

On  perusal of the record  it is revealed  that the O.P  had   floated a housing plot scheme  at Sitanagaram village near to railway station under jogimpeta Grampanchayat of Bobbili Mandalam Vizianagaram  State: Andhra Pradesh   in the name and style  of     Balaji  Real Estates, for selling  of  Residential  lay out plots to the parties 15 x 50 feet  plot booking 3(three) Nos.688, 689, 690.  Being impressed by the scheme  the complainant  had   deposited  amount  on installment  basis for 3 plots   @ Rs. 4,500/- per month  for 50 (fifty) installments  amounting to Rs. 2,25,000/- (copies of the  money receipts  are available in the file  which are marked as  Annexure- 1 to 14).

            The main grievance of the complainant  is that  inspite of  payment  towards   sale consideration   as per the scheme,  the O.P. did not turn up to make registration of the house sites  in favour of  complainant  nor the O.P refunded  the amount which was paid . Hence the C.C. complaint.

During the exparte  hearing the complainant examined himself and filed  Money Receipt  which  was  issued  in favour of the complainant.  Further the complainant  proved the payment  of the  money  a sum of Rs. 2,25,000/-   to the O.Ps  in shape of  cash  which were mentioned  in the money receipt. The O.P. No.1(Agent) had  also  admitted in their written  version that  the complainant had paid  Rs.2,25,000/- to the O.P.No.2.

We find there is gross deficiency in service on the part of the O.Ps

The complaint petition is allowed in part.

To meet the ends of justice the following order is passed.

                                    ORDER.

In resultant the complaint petition  stands allowed in part against the  O.P. No.2.

The  O.P. No.2 is directed to  refund  the deposited amount Rs.2,25,000/- by the complainant according to  receipts along  with interest  @  Rs. 18%  per annum   from the  respective  date of  deposit  till  realization  inter  alia to pay Rs.1,000/- towards litigation expenses.

The O.P. No.1(Agent) is ordered to refer the matter to the O.P. No.2 for early compliance of the  above order and cooperate the complainant for better co-ordination with the O.P. No. 2 to provide satisfying service for which  he is entitled.

Miscellaneous  order if any  delivered by this  commission  relating to this case  stands vacated. 

 A copy of this order be provided to all the parties at  free of cost as mandated by the Consumer Protection Act,  2019 or they may download same from the confonet.nic.in to treat the same as if copy of order received from this Commission.
