ORDER

1.       This revision petition has been filed under section 21(b) of the Act 1986 in challenge to the Order dated 10.02.2021 of the State Commission in appeal no. 25 of 2020 arising out of the Order dated 11.12.2019 of the District Commission in complaint no. 372 of 2019.

2.       Learned counsel for the insurance co. (the petitioner herein) is present.

No one appears for the complainant (the respondent herein).

3.       The record shows that the District Commission had allowed the complaint in part, the State Commission had dismissed the appeal preferred by the insurance co.

Accordingly this petition has been filed by the insurance co. apropos concurrent findings of the two fora below.

4.       Further to the Order dated 08.07.2022, learned counsel for the insurance co. submits, on instructions, that the insurance co. has complied with the District Commission’s Order and as such it does not wish to pursue its revision any further. He however requests that the issues involved may be kept open and this case may not be treated as a precedent.

5.       In the wake of the above submissions, the revision appears to have been rendered infructuous and stands dismissed as such. However, the issues involved are kept open and the decision in this case shall not be treated as a precedent.  

6.       The Registry is requested to send a copy each of this Order to the parties in the revision and to the learned counsel for the insurance co. immediately. The stenographer is also requested to upload this Order on the website of this Commission immediately.
